Silicosis

Silicosis is a serious occupational lung disease caused by prolonged exposure to respirable crystalline silica dust. Workers in industries such as construction, mining, manufacturing, and stone cutting face heightened risks due to regular exposure to this hazardous material. If you or a loved one has been diagnosed with silicosis as a result of workplace conditions, you are likely entitled to workers’ compensation benefits under California law, but your employer and their insurance carrier might stand in your way. The California workers’ compensation attorneys at Invictus Law, P.C., are here to help injured workers in Orange County and the Inland Empire navigate their claims and secure the benefits they deserve.

What Is Silicosis?

Silicosis develops when fine silica dust is inhaled over time, causing inflammation and scarring in the lungs. The disease often progresses silently, with symptoms manifesting years after exposure. Common symptoms include persistent coughing, shortness of breath, fatigue and chest pain, and respiratory failure in severe cases.

There are three main types of silicosis: chronic, accelerated, and acute.

  1. Chronic Silicosis: Develops after 10-20 years of exposure to low levels of silica dust.
  2. Accelerated Silicosis: Occurs within 5-10 years of high exposure levels.
  3. Acute Silicosis: Results from intense exposure over a short period, often causing rapid onset of severe symptoms.

The disease is irreversible and can lead to life-threatening complications, including lung cancer, tuberculosis, and chronic obstructive pulmonary disease (COPD).

Occupations at Risk

Certain industries and occupations expose workers to higher silica dust concentrations. These include:

  • Construction Workers: Tasks such as cutting, grinding, or drilling concrete and masonry.
  • Stone Fabricators: Polishing or carving stone countertops and monuments.
  • Sandblasters: Cleaning or preparing surfaces with abrasive silica materials.
  • Miners: Drilling or crushing rock in quarries or coal mines.
  • Manufacturing Workers: Producing glass, ceramics, or other silica-containing materials.

California has regulations requiring employers to implement safety measures to limit exposure, such as ventilation systems, respirators, and wet cutting techniques. Despite these rules, unsafe practices and poor enforcement often put workers at risk.

Silicosis and Workers’ Compensation in California

California’s workers’ compensation system provides benefits for workers who develop occupational illnesses like silicosis. If you have been diagnosed, you may be eligible for medical benefits coverage for diagnostic tests, treatments, and ongoing care. You are also eligible for temporary disability benefits in the form of partial wage replacement if your condition prevents you from working temporarily. Permanent disability benefits provide compensation for lasting impairment caused by silicosis that prevents you from working. Assistance with job retraining (vocational rehabilitation) is available if you are not totally disabled but cannot return to your previous occupation. Death benefits, i.e., financial support for surviving family members, are provided if silicosis leads to a fatal outcome.

Challenges Workers Face in Silicosis Claims

Silicosis claims can be complex for several reasons, including the delayed onset of the condition. Symptoms often appear years after exposure, complicating proof of workplace causation. This issue can be particularly difficult when an employee worked for several employers over many years, encountering silica exposure at different jobs. Additionally, some employers or insurers may dispute the link between your job and the disease. Diagnosing silicosis and proving occupational exposure typically requires testimony from medical and industrial hygiene experts.

These challenges highlight the importance of working with an experienced workers’ compensation attorney to build a strong case.
